Das Recht auf informationelle Selbstbestimmung ist in der deutschen Rechtsordnung ebenso wie in unserem Alltag omniprasent. Svenja Behrendt geht der grundrechtsdogmatischen und (grund-)rechtstheoretischen Begrundbarkeit umfassend nach. Dabei stellt sie die diversen Fragen und Probleme auch in ihren dogmatischen und theoretischen Zusammenhangen dar und ordnet sie perspektivisch ein. Die Autorin zeigt, dass jenes Recht zwingend einen Anspruch gewahrleisten wurde, von anderen nicht wahrgenommen zu werden. Sie entwickelt ein grundrechtstheoretisches Modell, das mit einem positivistischen Verstandnis des Rechts kompatibel ist, und belegt damit die Unbegrundbarkeit eines solchen Anspruchs. Im Ergebnis ist das Recht auf informationelle Selbstbestimmung aus normstrukturtheoretischen Grunden nicht begrundbar. Skizziert wird auch, inwiefern ein informationeller Grundrechtsschutz anerkannt werden konnte.
