Para lograr todo lo anterior, el texto se presentará bajo la siguiente estructura: en la primera parte abordaremos la historia, fundamento y naturaleza de la prescripción penal; la segunda se concentrará en la figura de la imprescriptibilidad y se desarrollarán algunos apuntes históricos, se analizará el fundamento y la fuente normativa de ésta; en la tercera, se responderá el interrogante: ¿existen delitos imprescriptibles a la luz de la Constitución Política Colombiana? Allí se abordará el marco normativo de la discusión, se presentará la posición de la Corte Constitucional, la Corte Suprema de Justicia, así como de los Tribunales de Justicia y Paz; finalmente se exteriorizará la toma de postura y se presentarán las conclusiones y unos apuntes finales en el marco de la justicia transicional.
