The right of trade union association was first enshrined in Colombia by Law 78 of 1919. Only in 1936 did this right acquire a constitutional connotation, the year in which article 44 of the 1886 Constitution was amended by means of a legislative act. Although there was no explicit consecration of the right of association in the field of labor, Martinez and Zuluaga (2004) argue that the right to union association was understood as a manifestation of the right of association in its broadest sense, in other words, the right to union association was protected by Article 44 of the Constitution.
